    Please Note: The site originated in English and while an attempt has been made to include other languages, the English terms and conditions override all others.

    1) The prices you are quoted includes all local taxes, insurance and credit card charges. The price does not include your country's import duties. This is not usually a problem but certainly worth checking if you are buying an original. IN ADDITION, PLEASE NOTE that the pricing of the prints is dynamic, which means that the price of a print is dependent on which limited edition number it is and how long it has been since the last sale. As a result, the last in an edition may cost 5 time more than the first. This takes effect once each day so please be aware that prices may have gone up by tomorrow.

    2) All original paintings will arrive stretched over a wooden frame with the edges painted a dark colour. This allows you to hang it immediately and can be easily framed.

    3) Prints are on Matt canvas or paper depending on your request. Other options are available.

    4) All prices are based and billed in Great British Pounds. Conversion rates are estimates.

    5) Product weights are not true weights but reflect the weight/volume calculation imposed by shippers. The weights listed for each product will return the correct shipping cost.

    6) You may order from different artists from the one shopping cart. In this event, the work from different artists will almost certainly arrive at different times.

    7) It is your responsibility to check the painting is in perfect condition on arrival. Notice of damaged merchandise must be submitted to ArtOak in writing within 72 hours upon documented delivery date by the shipping courier. Damaged artwork needs to be returned to ArtOak for inspection before refunds or replacements can be submitted. In some instances, ArtOak may waiver this requirement upon discretion of ArtOak management. Upon contacting ArtOak further details on replacement procedures will be provided.

    8) All original paintings are shipped sandwiched in bubble wrap and then oversized plywood. This can withstand significant impact and has so far provided completely effective.

    9) Original paintings will only be sent by air courier. This is a requirement of customs

    10) In the event you are unhappy with an original painting you must return it within 1 week. You will be refunded the total amount less the shipping and insurance. Your refund will be made once the painting is returned and seen to be in the same condition it left in.

    11) All commissions require a 40% (non-refundable) deposit on order and the final payment on completion of the commission, receipt of a photo and before shipping. If you are unhappy with the commission once in possession of it although having agreed to the photo, one alteration will be made free of charge although you will be responsible for the additional shipping costs.

    LIMITED EDITIONS

    The text on the Limited Edition Certificate states

    This numbered edition is from an authentic single limited publication.
    It is produced using the method of ‘Pigmenta Fine Art Print’; high quality print by pigmented inks on long lasting medium and is approved, signed and numbered by the artist,
    To ensure the integrity of the edition, all origination, files and test copies are destroyed on completion.
    The artist and publisher hereby affirm the authenticity of this limited edition with this certificate.
    This certificate is valid together with the same serialised holographic sticker on the fine art print only.

    For security reasons, the certificate and second hologram will be sent separately to the print. Once you have both print and certificate, stick the hologram to the back of the print to authenticate the pair. An example certificate is displayed below.

    General Terms of this Site

    ArtOak refers to the the art gallery and the managing company that controls it. ArtWork refers to all the crafted work that can be found on ArtOak, including but not limited to original paintings, prints and jewellery.

    • Customers are responsible for reviewing and ensuring ArtOak receives the complete and correct address information for shipping purposes.
    • Payment is required in full prior to processing orders.
    • Stretched and mounted prints apply to canvas prints only.
    • Stretched canvas prints will be stapled on the sides with the printed area covering the facing surface of the canvas or on the back for prints 20 x 30" or larger or where at least one side exceeds 30". Gallery wrapping in which the image wraps around to the back of the frame is not an option.

    Replacements & Refunds

    Customer satisfaction is paramount with ArtOak. In all cases we will try to ensure that all customers receive the service they deserve. In some instances it may be necessary for ArtOak to replace or refund damage prints. Below are general guidelines that ArtOak follows in servicing our customers.

    ArtOak is not responsible for damage accrued to artwork after they have been delivered and caused by the customer or a third party. Third parties may include but is not limited to framers, retail establishments, or an artist's customers.

    Grounds that are not acceptable reasons for replacement or refund include but are not limited to differences in color tones or hues than expected, substrate properties, smudging, fingerprints or scratches that occur due to your handling, direct exposure to the elements such as heat and moisture, late deliveries or incorrectly submitted shipping addresses.

    Rush order charges are not refundable unless an order is not documented by the courier as either delivered to the shipping address or having a delivery attempt by the end of the expected receiving date. Customers are responsible for ensuring a person is present to receive the rush order.

    Liability

    ArtOak is not liable for damage or injury to items, animals or people caused by the artwork due to negligent, reckless, knowing or intentional actions by any person. By purchasing from ArtOak, the customer assumes all responsibility for damages or injuries caused by the artwork once it reaches its shipping destination. ArtOak is not responsible for lost or damaged property shipped to ArtOak for evaluation or production work.

    Shipping & Delivery

    ArtOak usually will have orders completed and delivered within 5 to 15 business days. Factors that may delay delivery of an order within that time frame may include weather, order size, equipment malfunctions, or disaster. Customers that have not received their orders within 15 business days may contact ArtOak for an order status check. Rush orders may be available during certain times of the year and accrue additional production and shipping charges. Contact ArtOak to discuss placing a rush order. International orders may take longer than 5 to 15 working days and is dependent upon the shipping schedule of the courier used. Shipping charges may be based upon the total amount of an order in order to cover cost of parcel weight, size, destination and packaging.

    Elements within this Terms of Service policy are subject to change without notice and at the discretion of ArtOak the owner of this site. We reserve the right to refuse any sale or commission.

     

    Artists:

    1) It is free to display your artwork.

    2) ArtOak reserves the right to choose which artists are displayed and when.

    3) ArtOak will incorporate all the pictures, develop the site and pay for marketing. You will need to provide between 8 and 20 pictures of different pieces, an artist profile plus your terms and conditions if different from the general ones above.

    4) ArtOak will take payment and deduct a 10% gallery fee on the net Sales (after paypal or 2CO commissions have been paid) before forwarding payment to the artist.

    5) The individual artist is resonsible for producing and posting all artwork under their name.

    6)ArtOak sells in GBP's. ArtOak will make available all statements provided by PayPal and 2CO to ensure transparency.

    7) If in the UK you will be paid by bank transfer (5 working days) and international payments will be made however you wish.
